By creating an account, uploading files, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
dirtysnow is a self-hosted file storage and sharing tool provided on an "as is" and "as available" basis. We do not promise that the Service will be uninterrupted, timely, secure, error-free, or that any data will be preserved. You use the Service at your own discretion and risk.
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into these Terms. By using the Service you represent and warrant that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must choose a strong, unique password, keep it secret, and notify the operator promptly of any suspected unauthorized use. We are not liable for any loss or damage arising from your failure to safeguard your credentials or account.
You retain ownership of the files and content you upload ("Your Content"). You are solely and entirely responsible for Your Content, including its legality and accuracy and the consequences of uploading, storing, or sharing it. You represent and warrant that you own or have all rights necessary to Your Content and that it does not violate any law or the rights of any third party. We do not monitor, review, endorse, or assume any responsibility for Your Content.
You agree not to use the Service to upload, store, share, or transmit any content, or to engage in any activity, that: (a) violates any applicable law or regulation; (b) infringes any intellectual-property, privacy, publicity, or other right; (c) contains malware, viruses, or other harmful code; (d) is unlawful, harmful, harassing, defamatory, or obscene; (e) attempts to gain unauthorized access to the Service, other users' accounts, or any system or network; (f) interferes with, disrupts, or imposes an unreasonable load on the Service; or (g) probes, scans, or circumvents any security feature without authorization. Ensuring that your use complies with every law that applies to you is your responsibility alone.
The Service lets you generate links that allow anyone who has the link to download the associated file without logging in. You are solely responsible for deciding whether to create such links and for controlling their distribution. Anyone holding a valid link can access the file until you revoke it. We are not responsible for any access to, or disclosure of, files you choose to share, however that access occurs.
The Service is not a backup service. You are solely responsible for maintaining independent backups of Your Content. We do not guarantee that any file, account, or data will be retained, and Your Content may be lost, corrupted, or deleted at any time and for any reason, including hardware failure, software error, misconfiguration, attack, or discontinuation of the Service. To the maximum extent permitted by law, we have no liability for any loss or corruption of data.
To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Service will be available, accurate, reliable, or secure, or free of viruses, vulnerabilities, or errors. To the maximum extent permitted by applicable law, in no event will DIRTYSNOW or its owners, operators, contributors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service, any unauthorized access to or alteration of your data, or any conduct or content of any third party, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages. To the maximum extent permitted by applicable law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us to use the Service in the twelve months preceding the event giving rise to the claim, or (b) US $0.
You agree to defend, indemnify, and hold harmless DIRTYSNOW and its owners, operators, and contributors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party.
We may suspend, restrict, or terminate your access to the Service, or delete Your Content, at any time and for any reason, with or without notice, and without any liability to you. You may stop using the Service at any time. Provisions that by their nature should survive termination — including Sections 4 through 11 and 13 through 16 — will survive.
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; the updated Terms take effect when posted. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
